This comes after the recent trial outcome that deemed Storm guilty of one of three accusations.<\/p>\n<h2 style=\"font-weight: 400;\">Ethereum Foundation Aids Tornado Cash\u2019s Co-Founder<\/h2>\n<p style=\"font-weight: 400;\">On Thursday, the Free Pertsev and Storm fundraising initiative <a href=\"https:\/\/x.com\/FreeAlexeyRoman\/status\/1953539111685632116\" target=\"_blank\" rel=\"noopener nofollow\">unveiled<\/a> that the Ethereum Foundation will match contributions up to $500,000 to assist the Tornado Cash co-founder\u2019s legal defense in light of this week\u2019s judgment.<\/p>\n<p style=\"font-weight: 400;\">In a post on X, the fundraising group explained that they \u201cwill require these funds and more to continue the battle for Roman at the trial court and during appeal. The result of these proceedings will establish significant precedent for developers around the globe.\u201d<\/p>\n<p style=\"font-weight: 400;\">As <a href=\"https:\/\/bitcoinist.com\/ethereum-foundation-donates-1-25-million-to-tornado-cash-developers-legal-defense\/\" target=\"_blank\" rel=\"noopener \">stated<\/a> by Bitcoinist, the US Department of the Treasury\u2019s Office of Foreign Assets Control (OFAC) penalized Tornado Cash in August 2022 for failing to implement adequate measures to hinder malicious actors from laundering assets via the protocol, including $455 million linked to the North Korea-associated hacking group, Lazarus Group.<\/p>\n<p style=\"font-weight: 400;\">Storm was arrested and charged following the Tornado Cash sanctions, facing accusations of conspiracy to commit money laundering, conspiracy to violate sanctions, and conspiracy to operate an unauthorized money-transmitting service.<\/p>\n<p style=\"font-weight: 400;\">On August 6, the result of the long-anticipated trial, which began on July 14 after being postponed twice, was <a href=\"https:\/\/bitcoinist.com\/mixed-verdict-for-tornado-cash-founder\/\" target=\"_blank\" rel=\"noopener \">declared<\/a>. Notably, the jury could not reach a unanimous conclusion regarding two of the three charges: conspiracy to commit money laundering and conspiracy to violate sanctions.<\/p>\n<p style=\"font-weight: 400;\">Nevertheless, the jury found the Tornado Cash co-founder guilty of the remaining count: conspiracy to operate an unauthorized money transmitting business, which could result in a 5-year sentence for the crypto mixer\u2019s co-founder.<\/p>\n<p style=\"font-weight: 400;\">After the ruling, he <a href=\"https:\/\/x.com\/EleanorTerrett\/status\/1953146088602427664\" target=\"_blank\" rel=\"noopener nofollow\">commented<\/a> to journalist Elenor Terret that the outcome was \u201ca significant victory. The \u20181960\u2019 charge is nonsensical and we\u2019re going to contest it thoroughly. You know how President Trump said \u2018fight, fight, fight\u2019? We\u2019ll do just that.\u201d<\/p>\n<p style=\"font-weight: 400;\">As the Free Pertsev and Storm team elaborated, \u201cRoman faces up to 5 years of imprisonment if he does not succeed in the appeal, and potentially decades if the government opts to retry Counts 1 &amp; 3.\u201d<\/p>\n<h2 style=\"font-weight: 400;\">What Lies Ahead For Storm\u2019s Defense?<\/h2>\n<p style=\"font-weight: 400;\">Unchained host and journalist Laura Shin <a href=\"https:\/\/www.youtube.com\/watch?v=AYCLVQddptY&amp;t=1824s\" target=\"_blank\" rel=\"noopener nofollow\">conducted an interview<\/a> with former prosecutor Sam Enzer to discuss the mixed ruling and what\u2019s next for the Tornado Cash co-founder. Enzer highlighted that before proceeding to appeal, \u201cRoman can request a new trial or a judgment of a quibble.\u201d Following that, \u201cthere will be a briefing on that. The court, Judge Failla will decide.\u201d<\/p>\n<p style=\"font-weight: 400;\">As the former prosecutors pointed out, if the Judge determines that the conviction was correct regarding the conspiracy to operate an unauthorized money transmitting business count, they could advance to sentencing. Furthermore, the government could retry Storm on the two counts where the jury was deadlocked.<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">Thus, retrials are a possibility, or the judge might conclude that the conviction was improper and could state that on the counts where the jury was indecisive, those should have been dismissed.<\/p>\n<\/blockquote>\n<p style=\"font-weight: 400;\">Enzer asserted that if either of these \u201cextreme\u201d <a href=\"https:\/\/bitcoinist.com\/sec-commissioner-protect-crypto-privacy-developers\/\" target=\"_blank\" rel=\"noopener \">results<\/a> occurs, the case could progress to appeal after navigating through the district court, adding that \u201cwho appeals will hinge on the result. If the government is dissatisfied with the outcome, they\u2019ll be the ones appealing.
