{"id":11925,"date":"2025-05-10T07:55:38","date_gmt":"2025-05-10T05:55:38","guid":{"rendered":"https:\/\/wsj-crypto.com\/?p=11925"},"modified":"2025-05-10T07:55:38","modified_gmt":"2025-05-10T05:55:38","slug":"prosecutors-in-samourai-wallet-case-maintain-compliance-with-brady-rule","status":"publish","type":"post","link":"https:\/\/wsj-crypto.com\/index.php\/2025\/05\/10\/prosecutors-in-samourai-wallet-case-maintain-compliance-with-brady-rule\/","title":{"rendered":"Prosecutors in Samourai Wallet Case Maintain Compliance with Brady Rule"},"content":{"rendered":"<p><\/p>\n<div>\n<p class=\"nitro-lazy\">In a correspondence submitted today to the Southern District of New York (SDNY), the attorneys representing the <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/founders-and-ceo-cryptocurrency-mixing-service-arrested-and-charged-money-laundering\" target=\"_blank\" rel=\"noopener\">Samourai Wallet matter<\/a> asserted that they did not <a href=\"https:\/\/bitcoinmagazine.com\/legal\/sdny-withholding-of-evidence-undermines-charges-against-samourai-wallet\">retain exculpatory evidence<\/a> and asked the judge to reject the defense\u2019s petition for a hearing concerning the delayed revelation of crucial information obtained from <a href=\"https:\/\/www.fincen.gov\/\" target=\"_blank\" rel=\"noopener\">FinCEN<\/a> almost two years prior.<\/p>\n<p>Earlier this week, the defense stated in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.620167\/gov.uscourts.nysd.620167.86.0.pdf\" target=\"_blank\" rel=\"noopener\">notice<\/a> that they had discovered that FinCEN had \u201cstrongly suggested\u201d that Samourai Wallet was not functioning as a money transmitting business due to the noncustodial characteristics of the service in discussions with specific FinCEN staff members (more on these individuals in the subsequent sections) and the prosecutors on August 23, 2023.<\/p>\n<p>This information surfaced thanks to a <a href=\"https:\/\/www.shouselaw.com\/ca\/defense\/legal-defenses\/brady-motion\/\" target=\"_blank\" rel=\"noopener\"><em>Brady<\/em> motion<\/a> submitted by the defense. (This type of motion is named after the <em>Brady v. Maryland<\/em> Supreme Court case from 1963, which established the <em>Brady<\/em> rule mandating that exculpatory evidence be made available to the defense as part of due process.)<\/p>\n<p>Considering that one of the two accusations against the Samourai developers includes conspiracy to conduct an unlicensed money transmitting operation, some believed this newly revealed information could justify dismissing the case.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<p> <iframe title=\"Samourai Wallet Case BOMBSHELL - Did the DOJ Hide Evidence? | Bitcoin Politics feat. Zack Shapiro\" width=\"814\" height=\"458\" src=\"https:\/\/www.youtube.com\/embed\/SVVz_ApsZeY?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe> <\/p>\n<\/figure>\n<h2 class=\"wp-block-heading\">No Dismissal, No Hearing<\/h2>\n<p>Nevertheless, today\u2019s correspondence from the prosecutors indicates they have no plans to discontinue the case, nor do they consider the hearing requested by the defense to be justified.<\/p>\n<p>\u201cThere is no justification for a hearing, nor is there any issue to rectify: the disclosure itself demonstrates that the government has not breached <em>Brady<\/em>,\u201d the prosecutors articulated in the letter. \u201cThe Government disclosed all known substantive communications between the prosecution team and FinCEN months ahead of pretrial motions and trial.\u201d<\/p>\n<p>The prosecutors emphasized that they intend to continue with the case, underscoring the second charge: conspiracy to engage in money laundering.<\/p>\n<p>\u201cAs alleged, Samourai laundered over $100 million in criminal proceeds sourced from, among other unlawful origins: illegal darkweb marketplaces such as Silk Road and Hydra Market; various wire fraud and computer fraud schemes that defrauded victims of funds, encompassing web-server intrusions, a spear phishing operation, and schemes to mislead multiple decentralized finance protocols; as well as other illicit activities,\u201d they wrote.<\/p>\n<h2 class=\"wp-block-heading\">Minimizing The Input From FinCEN<\/h2>\n<p>Moreover, the prosecutors argued that their recent disclosure of communications with FinCEN is insignificant to the case, as a substantial portion of the alleged conduct does not hinge on FinCEN regulations.<\/p>\n<p>They further minimized the significance of the views expressed by the FinCEN employees who interacted with the prosecutors: Kevin O\u2019Conner (Chief of FinCEN\u2019s Virtual Assets and Emerging Technology Section within the Enforcement and Compliance Division) and Lorena Valente (a member of FinCEN\u2019s Policy Division when she communicated with the prosecution).<\/p>\n<p>The prosecutors characterized O\u2019Conner and Valente\u2019s perspectives as \u201cindividual, informal, and caveated,\u201d noting they had already shared \u201csubstantive email exchanges between the prosecution team and FinCEN representatives pertaining to the August 23, 2023 conversation.\u201d<\/p>\n<p>They further stated that \u201cthe individual FinCEN employees were not representing FinCEN, they were not conveying FinCEN\u2019s stance, and they \u2018did not have insight into what FinCEN would determine if this matter were presented to their FinCEN policy committee.\u2019\u201d<\/p>\n<h2 class=\"wp-block-heading\">No <em>Brady<\/em> Breach<\/h2>\n<p>In the concluding section of the letter, the prosecutors maintained that they had not transgressed legal standards by failing to present specific details of their August 23, 2023 dialogue with FinCEN until now in the pre-trial proceedings.<\/p>\n<p>\u201cThe records indicate that there was no <em>Brady<\/em> violation in this instance,\u201d the prosecutors noted.<\/p>\n<p>\u201cThe government informed the defense about the content of this informal discussion prior to pretrial motions, and approximately seven months ahead of trial due to a request for that information,\u201d they added. \u201cNo further action is necessary.\u201d<\/p>\n<p>Lastly, referencing a <a href=\"https:\/\/www.ca2.uscourts.gov\/\" target=\"_blank\" rel=\"noopener\">Second Circuit<\/a> ruling included in their letter, the prosecutors mentioned that as long as the defense receives <em>Brady<\/em> evidence timely for effective utilization, the government has not denied the defense due process.<\/p>\n<h2 class=\"wp-block-heading\">What Comes Next?<\/h2>\n<p>The timeline for when Judge Berman will address today\u2019s letter from the prosecution remains unclear.<\/p>\n<p>The defense\u2019s initial motion was initially set for today but has been delayed by two weeks.
